Privacy policy on the processing of personal data as part of the online application process

1. General information The protection and confidentiality of your personal data is of particular importance to us. We collect and use your personal data exclusively in compliance with the applicable data protection laws. This privacy policy informs you which of your personal data we process for which purposes during the application process, and which rights you have regarding your personal data. 2. Personal data and applicant data According to article 4 (1) GDPR, personal data means any information relating to an identified or identifiable natural person (in the following referred to as “Data Subject”) (referred to as “Data”). On the one hand, this includes Data on the use of online services and websites, such as IP addresses. On the other hand, the term includes such Data that you provide as part of your application, i.e. your name, postal address, e-mail address, telephone number, letter of motivation, CV, training and job references, letters of recommendation, photos, and other documents (in the following collectively referred to as “Applicant Data”) and Data that is freely available about you on social media platforms such as LinkedIn and Xing. 4. Applicant Data, processing purposes and legal bases

4.1 If you apply for one of the positions offered on the Schörghuber careers page at schoerghuber.group/en/career, we will store and process your Applicant Data and any publicly accessible Data about you (LinkedIn, Xing).

4.2 We process your Applicant Data for the purpose of processing your application, deciding whether or not to establish an employment relationship with you, and communicating with you about your application. If an employment relationship is established with you, we will transfer the Data to your personnel file and process it insofar as that is necessary for establishing, performing and/or terminating the employment. This also includes data processing for carrying out or fulfilling the rights and duties arising from law or a collective bargaining agreement, a company or service agreement (collective agreement). All Data not required for these purposes will be deleted, provided that there are no statutory retention obligations to the contrary.

4.3 The legal bases for the processing of the personal Data concerned are article 6 (1f) GDPR and article 6 (1c) GDPR, i.e. on the one hand establishing, implementing and/or terminating an employment and on the other hand the fulfillment of legal obligations to which we are subject in connection with the employment relationship.

4.4 If no employment relationship is established, we will store your Applicant Data for a period of six months to defend ourselves against any claims that might be raised against us in connection with the application process. The legal basis for the associated data processing is article 6 (1f) GDPR, i.e. our legitimate interest in being able to defend ourselves against claims by submitting suitable documents. After six months, your Data will be deleted unless you have given us your consent to a longer storage period or we are entitled to store the Data for a longer period for another legal reason.

4.5 If no employment relationship is established and you give us your consent by e-mail, we will store your Applicant Data in our talent pool for a period of two years. If there are vacancies during this period and your application details match the vacancy, we will inform you by e-mail and invite you to apply for the advertised position. After the two-year period, we will delete your Applicant Data. You can revoke your consent at any time by sending an informal e-mail to:

5.1 If you apply for one of the positions offered on the Schörghuber careers page at schoerghuber.group/en/career, your Applicant Data will be transfered via TLS encryption and stored in a database. This database is operated by Personio GmbH, who supply personnel administration and applicant management software (https://www.personio.de). In this respect, Personio act as a data processor for Schörghuber being the controller under data protection law on the basis of a respective data processing agreement.

5.2 We do not transfer your Applicant Data to any third parties.

6. Your rights If the legal requirements are met, you have the following rights in relation to your Data:
  • the right to information,
  • the right to rectification or erasure,
  • the right to restrict processing,
  • the right to object to the processing,
  • the right to data portability.
